Goods and Service Tax
All prices shown include (10%) Australian GST as ACI Security Solutions only supply proven product that is passed for Australia only.  

Our Liability
We will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise.

Our maximum aggregate liability for any product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the product(s) in question.

Title To Goods
1 Notwithstanding delivery of the goods to the purchaser, until the purchaser has effected full payment for the Goods and any other goods previously supplied by The Company:

a) legal title to the Goods will remain with The Company or its preffered suppliers;
b) the risk in the Goods will pass to the purchaser on delivery to the purchaser or its agent;
c) the relationship between The Supplier and the purchaser will be fudiciary;

2 The Purchaser will:
a) hold the Goods as bailee for The Company;
b) keep the goods separate from other goods; and
c) label the goods so that they are identifiable as the goods of The Supplier;

3 With The Suppliers consent (which is given) the purchaser is at liberty to sell the Goods, in the ordinary course of the purchaser's business, provided that the money from the sale will:
a) be held in a separate account in trust for the vendor;
b) not be mingled with other money; and
c) not be placed into an overdrawn account

4 The purchaser is not an agent of The Supplier / Company in any sale of the Goods by the purchaser.

5 After the happening of an Event of Default, the vendor may without demand retake possession of the Goods and may without notice sell the Goods on such terms and in such a manner as it determines and will be entitled to deduct all expenses incurred. For the purposes of recovering possession and without limiting the generality of the foregoing, the purchaser irrevocably authorises and licenses The Supplier / Company and its servants and agents to enter any premises where any Goods may be stored and to take possession of the Goods.

Trade Payment
In addition to the above Title to Goods policy The Company has specific payment terms in relation to trade payment.
Payment/ partial payments and deposits taken via signed trade voucher are subject to full payment conditions as follows: if full payment of the invoice has not been received within 14 days of the invoice date, and the goods have been received, accepted and a signed deposit has been made then ACI Security reserve the right to process an automatic payment via the trade portal and/ or SMSPos to recover the outstanding balance.

Warranties
If any defect in materials or workmanship in product sold by ACI Security Solutions is identified and notified to us within the warranty period with a hard-copy proof of purchase docket then we will, at our discretion either: repair or replace the product.

ACI Security Solutions does not accept any liability beyond this, and does not accept any liability for consequential loss.

Our liability under this warranty is subject to ACI Security Solutions being satisfied that a defect was caused by defective workmanship or materials and was not caused by or substantially contributed to by other factors or circumstances beyond our control, including (but not limited to) defective installation, maintenance or repair (this also includes being installed by an un-licensed security operative); alteration or modification of the product in a manner not recommended by the manufacturers; or any neglect, misuse or excessive use.

This warranty does not extend to, and we are not liable for any damage to articles to which a product is attached or with which it is used, or for the consequences of a product being used for any purpose for which it has not been designed or for use which is not recommended by the manufacturers.

Freight charges relating to warranty items
Warranty repairs or replacements of goods is free of charge however freight charges to the service department is required to be paid by the customer, unless prior advanced plans have been made.
